Brand strategy and development
AI-powered SaaS growth systems

4. Eligibility

Our services are intended for businesses and individuals who are at least 18 years of age. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

5. Service Engagement

5.1 Scope of Work

The specific scope of services, deliverables, timelines, and pricing will be outlined in separate service agreements, proposals, or contracts entered into between you and Hypetree.

5.2 Client Responsibilities

You agree to:

Provide accurate and complete information necessary for service delivery
Respond to requests for information or feedback in a timely manner
Provide access to necessary accounts, platforms, or materials as required
Comply with all applicable laws and regulations

5.3 Our Responsibilities

We agree to:

Deliver services in a professional and timely manner
Use commercially reasonable efforts to meet agreed-upon deadlines
Maintain confidentiality of your business information
Communicate clearly about project status and any issues

6. Payment Terms

6.1 Fees

Service fees will be specified in your service agreement or proposal. All fees are in euros (EUR) or US dollars (USD) unless otherwise specified.

6.2 Payment Methods

We accept payments via Stripe and other approved payment methods. Payment processing is subject to the terms and conditions of the payment provider.

6.3 Payment Schedule

Payment terms will be outlined in your service agreement and may include:

Upfront deposits or retainers
Milestone-based payments
Monthly recurring payments
Project completion payments

6.4 Late Payments

Late payments may result in suspension of services until payment is received. We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.

7. Refunds and Cancellations

7.1 Refund Policy

Services are generally non-refundable once work has commenced
Deposits and retainers are non-refundable
Refunds for unused services may be considered on a case-by-case basis
All refund requests must be submitted in writing to hello@hypetr.ee

7.2 Cancellation Policy

You may cancel services by providing written notice to hello@hypetr.ee
Cancellation must be provided at least 14 days before the next billing cycle for recurring services
You are responsible for payment of all services rendered up to the cancellation date
Early termination may result in fees as outlined in your service agreement

7.3 Our Right to Terminate

We reserve the right to suspend or terminate services if:

Payment is not received within the agreed timeframe
You violate these Terms or any service agreement
You engage in fraudulent, illegal, or abusive behavior
Continuation of services is not feasible or practical

8. Intellectual Property

8.1 Ownership of Deliverables

Upon full payment, you will own the final deliverables specifically created for you as outlined in your service agreement. This includes custom website designs, content, and marketing materials created exclusively for your project.

8.2 Our Property

We retain ownership of:

Pre-existing materials, templates, and tools
Our methodologies, processes, and business practices
General knowledge and skills gained during the project
Portfolio rights to showcase our work (unless confidentiality is agreed upon)

8.3 Third-Party Materials

Any third-party tools, software, or materials used in delivering services remain the property of their respective owners and may be subject to separate licensing terms.

9. Confidentiality

We will maintain the confidentiality of your proprietary business information and will not disclose it to third parties except as necessary to provide services or as required by law.

10. Limitation of Liability

To the maximum extent permitted by law:

Our total liability for any claims arising from services provided shall not exceed the amount paid by you for the specific services giving rise to the claim
We are not liable for indirect, incidental, consequential, or punitive damages
We do not guarantee specific results, rankings, traffic levels, or revenue outcomes from our marketing services

11. Warranties and Disclaimers

11.1 Services Provided "As Is"

While we strive for excellence, services are provided "as is" without warranties of any kind, express or implied.

11.2 No Guarantee of Results

Marketing and growth services involve many variables outside our control. We do not guarantee specific results, search engine rankings, traffic levels, conversion rates, or revenue outcomes.

11.3 Third-Party Platforms

We are not responsible for changes, outages, or policies implemented by third-party platforms (Google, Facebook, etc.) that may affect service delivery or results.

12. Indemnification

You agree to indemnify and hold harmless Hypetree OÜ, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of our services
Your violation of these Terms
Your violation of any third-party rights
Any content or materials you provide to us

3. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Estonia, without regard to conflict of law principles.

13.2 Negotiation

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation.

13.3 Jurisdiction

Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Estonia.

14. Changes to Terms
